Mediation
Q: What differentiates you as a mediator?
A: I was trained in Advanced Mediation at the Straus Institute for
Dispute Resolution, Pepperdine University School of Law. I have
been actively involved in over one thousand mediations in varying
capacities. A number of these cases involved eight figure settlements.
As National Director of Major Litigation at St. Paul Insurance Companies,
I was able to observe the skills of top mediators from all areas
of the country in resolving cases. I continue my education to stay
abreast of new techniques and issues in the mediation field. I will
be attending "Mediating the Complex Case: Process Design, Expert
and Party Management and Insurance Coverage" at Pepperdine
University.
The Chief Justice of the Georgia Supreme Court appointed me to The
Supreme Court of Georgia's Commission on Alternative Dispute Resolution.
In my various positions with St. Paul, and as a mediator, I have
concluded 100's of cases in ranges up to and including eight figured
settlements.
Consulting
Q: Why would I consider your services as a consultant in a case
that I have?
A: I can bring to the table a value added service based on my experience
in the insurance industry as well as my experience as a mediator.
During the consulting process I can assist in evaluation, negotiation,
resolution strategy, and attend mediations. I will make the best
possible use of my expertise in these areas with the goal of an
early settlement, or a good result if tried.
I have extensive experience in working with jury consulting providers.
I can assist you in the selection of these services, as well as
coordination of mock trials. I can assist with cost containment
at all levels of this process.
I am one of very few professionals who can offer a unique service
based on experience from a background in insurance, mediation, and
structured settlements.
Structured Settlements
Q: You are now involved in the structured settlement process. Tell
us about that.
A: At the urging of several members of the bar, I have obtained
my license, and I am now affiliated with The Pension Company. The
Pension Company is a leading national provider of comprehensive
financial services for injured claimants in legal actions.
I was one of the first in the insurance industry in Georgia to conclude
cases using structured settlements. I introduced this concept to
the Georgia defense and plaintiff bar in 1980. I was a speaker at
the State Bar of Georgia, and Georgia Trial Lawyers Association
on this subject.
Q:
Can this be incorporated in the consulting process?
A: Yes. My consulting services are pro bono if the case settles with
a structured settlement.
Q: Can you represent either side in this process?
A: Yes. In the early usage of Structured Settlements only the defendant
provided the structured settlement agent to assist both sides in getting
the cases resolved. As the concept developed, Structured Settlements
became a very serious viable tool. The plaintiff now retains their
own agent to assist in compiling important information that will be
used to evaluate and prepare the proposals that are presented and
offered. In these situations, the agents work together to assure that
the case is concluded in a manner that is satisfactory to both the
plaintiff and the defendant. Working through The Pension Company,
I am able to seek out the best pricing among all Life Insurance Companies
to get the best structure for your clients.
My experience and knowledge allows me to represent either party, defendant
or plaintiff. Expert Witness
Q: Can you serve as an expert witness?
A: Yes, I have experience in all aspects of claim handling policies
and procedures.
I am actively engaged in a number of "Bad Faith" claims including excess of policy limits suits. References available upon request.
I also have experience and knowledge about the mediation process,
and confidentiality agreements. This is a new and emerging issue
with the law, and would be glad to discuss the various specific
aspects as they evolve. I have been involved in cases with all of
these issues.
